Minimum Maintenance Standards

Background
The minimum maintenance standards were developed to provide municipalities with a defence against liability from actions arising with regard to levels of care on roads and bridges. Regulation 239/02, which came into force on November 1, 2002, contains the minimum maintenance standards. OGRA prepared several documents to assist municipalities and these are posted below.
Review of Minimum Maintenance Standards
To comply with Regulation 239/02, a review must be completed before the end of 2007. OGRA will establish a review committee that will report to OGRA’s Board of Directors. Interim reports will be made, as necessary, to the Board. Terms of Reference for the review committee will be drafted and posted here by mid-May, 2006. External stakeholders will be invited to have representation on the review committee. The review will be both a technical review to determine if they are appropriate and, as well, will evaluate whether the standards have provided municipalities with a defence from liability claims as addressed in Section 44(3) of The Municipal Act.
Municipalities are requested to advise OGRA of initial issues or concerns with the standards and whether they meet your needs both technically and as part of a risk management strategy.
